Surviving the Tariff Storm:Ā Legal Updates and Compliance Strategies

The U.S. trade regime has been transformed with a flurry of executive actions by the Trump administration, introducing multiple waves of tariffs on imports from almost all U.S. trading partners. The Trump Administration use of emergency powers for national security, border control, and illicit drug interdiction reasons have been found unconstitutional by the Court of International Trade and are currently under review by all of the judges of the Court of Appeals for the Federal Circuit. In addition, multiple actions on specific goods and specific unfair trade practices have increased duties substantially on many products in short supply in the U.S.

These moves, often issued with little notice and implemented rapidly, have thrust U.S. importers into uncharted territory. The legal mechanisms used—including the International Emergency Economic Powers Act (IEEPA), Section 232 of the Trade Expansion Act of 1962, and Section 301 Trade Act of 1974 — have broad implications for compliance, contract performance, profit margins, and supply chain stability.  

This webinar provides an outline of the status of all of the current trade actions and likely additional actions. We will discuss different approaches to mitigating the impact of higher tariff costs under the new tariff regime. Navigating the new tariffs is a critical risk management and compliance problem for many importers with real concerns about reasonable care.

Jim Holbein is an expert about international trade topics based on over 30 years of government and private sector experience. He is currently advising numerous clients about international contracts and transactions, Buy America compliance, and dealing with federal agencies.

Jim previously supervised a professional staff maintaining the Harmonized Tariff Schedule of the U.S. at the International Trade Commission (USITC). Additionally, he managed the NAFTA trade dispute settlement process while at the U.S. Department of Commerce and served as a diplomat and trade negotiator for the U.S. Department of State. 

Over the last six years, Jim has developed expertise in the emerging sectors of digital assets, blockchain, and decentralized autonomous organizations (DAO). He has written several articles on these topics, which build on his experiences leading IT development projects.
