Generally, IMMEX is a government program that allows Mexican companies to import into Mexico components, machinery, equipment, among other items to produce finished goods later withdrawn or removed for entry, or withdrawn and exported to another country, in which case Customs duty may be waived.  Like NAFTA, the USMCA may restrict the duties an IMMEX could potentially save. In general, USMCA article 2.5 retains drawback restrictions that existed under article 303 of the North American Free Trade Agreement (NAFTA) for non-originating materials incorporated into finished good which are consumed in the USMCA region.  This may require a U.S. and CA company to pay import for certain goods produced by IMMEX in MX.

IMMEX sounds like a very simple program that grants benefits to importers and exporters, but in reality, it is a very complex program that requires a high level of involvement and control, because one is under the radar and therefore constant scrutiny of the Mexican government. What can be viewed as a minor error or violation can actually result on the cancellation of the import license, or the IMMEX program itself.

If you do business with IMMEX, or with any other producer or factory in Mexico, (whether you own an IMMEX or are the supplier, buyer, transporter, customs broker, consignee of the materials, components, machinery, equipment, finished good, etc.), this webinar should be of interest to you, because there are several Mexican legal provisions applicable to IMMEX which are subject to changes constantly. Therefore, being aware of this in addition to knowing the main legal provisions will allow you to obtain the most benefit and also prevent problems with the authorities, who can be rather stringent regarding compliance.
